terms of service

Last updated: June 2026

By using this website, placing a commission, or purchasing merchandise, you agree to the following terms. Please read carefully before proceeding.

Payment

Commissions: A non-refundable deposit of 50% of the total agreed price is due before work begins. The remaining balance is due upon completion, prior to shipping or delivery. The final artwork will not be released until payment is made in full.

Merchandise: Payment is collected in full at the time of checkout. Orders will not be processed or shipped until payment is confirmed. I reserve the right to cancel any order and issue a full refund at my discretion.

Refund Policy

Commissions: All sales are final. No refunds will be issued once work has begun. The deposit is non-refundable under all circumstances, including cancellation. The sole exception is damage sustained during shipping — if your artwork arrives damaged, you must notify me within 48 hours of delivery with photographic evidence of both the damage and the packaging. Upon verification, I will offer a full refund, partial refund, or reproduction at my discretion.

Merchandise: All merchandise sales are final. I do not accept returns or exchanges unless an item arrives damaged or defective. If your order arrives in unacceptable condition, contact me within 48 hours of delivery with photos and I will work to make it right.

Intellectual Property

All artwork, illustrations, designs, and creative works displayed or sold on this website are the sole and exclusive intellectual property of the Artist. Nothing on this site transfers any intellectual property rights to you.

Commissions: You are granted a limited, personal, non-commercial license to display your commissioned piece for personal use only. You may not reproduce, print, manufacture, sell, sublicense, or otherwise exploit the work — in whole or in part — for any commercial purpose, including but not limited to: merchandise, apparel, physical or digital products for resale, or NFTs, without my express prior written consent. Unauthorized commercial use constitutes copyright infringement.

Merchandise: Purchasing a product from my shop gives you ownership of that physical item only. It does not grant you the right to reproduce, copy, or use the artwork on that product to create your own merchandise or derivative works. The underlying artwork remains my exclusive property.

Artist Credit

Whenever a commissioned work is publicly displayed or shared in any form, you agree to provide clear credit including the Artist's name and, where applicable, a link to this website or my social media. Failure to provide proper credit is a breach of these terms.

Confidentiality & Your Materials

Any reference images or personal materials you provide will be used solely to complete your commission and will not be shared publicly without your permission. Upon receipt of full payment for a commission, you own the physical artwork — however, I retain all reproduction rights and the right to photograph and share the work for portfolio and promotional purposes.

Service & Timeline

I reserve the right to adjust estimated completion timelines due to unforeseen circumstances and will communicate any delays promptly. Significant scope changes requested after a sketch has been approved may result in additional fees or an updated timeline at my discretion.

Limitation of Liability

My total liability is limited to the amount you paid for your order. I am not responsible for any indirect, incidental, or consequential damages, nor am I liable for delays or damage caused by third-party shipping carriers.

Warranty

All commissioned works are original, handmade paintings created by me. No other warranties are expressed or implied. We do not guarantee the finished work will match your subjective expectations, but we will make every reasonable effort to reflect the agreed-upon description and reference materials.

Merchandise is produced and fulfilled with reasonable quality standards. If a product is defective, see my Refund Policy above.

Resolving Disputes

These terms are governed by the laws of the State of New Jersey. In the event of a dispute, both parties agree to first attempt resolution through good-faith communication. If unresolved, disputes will be handled through binding arbitration or small claims court in the State of New Jersey, in the county where the Artist resides.

Right to Terminate

Either party may cancel a commission before work begins with written notice. If you cancel after the deposit is paid, the deposit is forfeited. If I cancel before completion, your deposit will be refunded in full. Intellectual property and liability provisions survive any termination.
